If you're looking to... contest a Parking Ticket... fight a Speeding Ticket... or some other kind of Motoring offence... this web page offers a very good starting point.  This page has a brief section on various aspects of... being stopped by the Police... getting a Ticket... fighting a Ticket... and going to Court... and links to different Articles which cover the issues in a lot more detail.  These Articles give a general overview of different Strategies which people adopt: [not necessarily all legal.]  Some Legal Tips...   • Start from scratch... do all your own research... check out Forums for advice... make up your own Letters.  Costs nothing... but is Time consuming and inconvenient... and has the least chance of success.
  • Access some of the Articles we have put together... utilise some of the Tips... form a Strategy... use our Template Letters.  Costs nothing... and should significantly increase your chances of success.
  • Purchase an ebook online... Legal Information... written by those in-the-know.  Covering your specific area of concern... includes, professionally written Template Letters... Strategies to adopt... checks for procedural anomalies which may invalidate the Ticket.  Costs = £20 - £40... good chance of success for a modest investment.
  • DIY Lawyers.  Get yourself a copy of "Wilkinson's Road Traffic Referencer 2007" and start searching through some "Case Law".  If you can find a previous Case that you can honestly say is exactly like yours... [nudge, nudge, wink, wink, know what I mean, say no more...] cite the Case as a precedent... and the Court should make the same decision as was previously given in any higher Court.  Costs = £59.  A lot of work... chances of success is entirely down to you.
  • Hire a Lawyer... and get specific Legal Advice... let them do all the work for you.  Costs = £2-£3 per minute to talk to you in person or on the phone...  £20+ to write each letter for you.  Will also represent you in Court... depending on the amount of work involved, could be £1-2000??  With a Lawyer specialising in Motoring Law... chances of success are quite high.
  • If you're extremely wealthy hire one of the top Lawyers who specialise in Motoring Law and there is a very good chance you will get off... or get the minimum of sentences... Costs = £10,000+

[Note: the Law is very complex... and they nearly all have conditions attached... or exceptions to the rule.]  If you do go and consult a Lawyer for Legal Advice about fighting some kind of Motoring Offence... they might have to look through a huge volume of Legal books... or they might be able to pluck some valuable snippet of Information straight out of the air... either way, they are going to charge you a small fortune for their expertise.  Most of this Legal Information is available somewhere... but it isn't easily accessible... and the Legal Professions aren't generally interested in making things any easier.  Fortunately there are a few exceptions... a lot of this essential Information is now available in ebook form... or you can access the publications that specialist Motoring Lawyers use: [details below.]

Avoiding a Speeding Ticket.

This is, basically, your first line of defence... not getting a Ticket in the first place.  There are a lot of strategies that people use... some legal... some not.  Most common are those that buy a cheap vehicle and don't bother registering it... consequently any Tickets don't catch up with them.  However, if they do get stopped then all their Tickets may be on record and they either have to pay them all or forfeit the vehicle.  This is strictly an option for those who have nothing to lose.  But... it is perfectly legal to use an accommodation address which then makes you very difficult to get hold of... and may invalidate some Tickets which need to be served within a specific time frame.

Other methods may include such things as GPS devices for Gatsos... Radar detectors... or anti-flash spray on the number plate.  None of these things give you the ability to drive around at any speed you like... if you persistently speed you will eventually get caught.  On the other hand... drivers do not know 100% of the time, the speed limit on the stretch of road they are travelling along... and their exact speed... especially if they are a high-mileage drive who uses lots of different roads.  The Police seem to be quite happy to prosecute anyone on a technicality regardless of the safety issues... so there is no reason why drivers should feel guilty about getting out of a Ticket on a technicality.  [Click the Link above to see a full list of strategies for avoiding Tickets.]

Getting Stopped by the Police.

This is one area where you really need to know all the dos and don'ts before you get stopped... what to do... what to say... and just as importantly... what not to do and what not to say.  By following some basic guidelines... you should minimise the risk of being issued with a ticket.  And if a ticket is issued... and you decide to challenge it... you will have avoided harming your case... and prepared the ground for your defence.  If you are stopped by Traffic Police they will probably give you a Ticket because that's their job... and they have quotas to meet.  If you get stopped by an ordinary Patrol Car... they might not have sufficient evidence and will be relying on you admitting to something.

If you do get stopped... you must give them your Name: Address and Occupation... if you refuse they can arrest you... if you give false details you could end up facing more serious charges.  Otherwise they can only arrest you for serious offences... like drink-driving.  Or... they could take your keys... or seize your vehicle for a number of reasons... if they believe you are uninsured... the vehicle is unroadworthy... have no licence... outstanding Fines... been used in connection with a crime... etc.  [Click the Link above to see a comprehensive list of dos and don'ts.]

Getting a Ticket.

Tickets will either be issued on the spot by the Police... or sent through the post after being photographed by a camera.  For the less serious offences you will be given or sent a FPN [Fixed Penalty Notice] which is typically a £60 Fine and 3 points on your licence.  If you decide not to pay the FPN and elect to go to Court... you will be sent a Summons... which basically just tells you to be at Court on a particular time and day.  For more serious offences you will be given or sent a NIP [Notice of Intended Prosecution] and the Summons will automatically arrive in due course.  The vast majority of people simply take their punishment and pay their FPN... or turn up in Court without putting up any sort of defence and accept what the Court gives them.

If you elect to go to Court... make life as difficult as possible for the CPS... they may examine the evidence against you... and if their case is not water-tight... they might withdraw the charges before it even gets to Court.  The CPS are public servants with a heavy workload... they simply don't want to get bogged down fighting loads of minor traffic offences they might lose anyway.

Lawyers who specialise in Motoring Law will refer to... "Wilkinson's Road Traffic Offences, 23rd edition"... which covers Motoring "Case Law"... costs about £300 a copy.  If you can find a scenario that matches your own, exactly... cite the Case in Court... and [as long as they believe you] the outcome should be the same.  There is now a publication for those who want to try it for themselves... Vehicle Cloning...

Request for Information.  Click these Links below.  Download a copy into a word processor... then fill in all your own specific details.  Write to them [use recorded delivery] and tell them you wish to contest it on the grounds that... it might not have been your Vehicle... you are not sure who was driving... you do not believe you were speeding, there must have been a fault with the equipment... or it was used incorrectly.  Basically, this just puts the ball back in their court!
